Özet

Kişisel bilgisayarlar sadece donanım unsurlarından meydana gelmeyip üstlen-dikleri fonksiyonları yerine getirebilmek için gayri maddi mal niteliğindeki yazılım olarak adlandırılan bileşenlere de ihtiyaç duyarlar. Bu durum, kişisel bilgisayarların hukuki niteliklerini belirlerken donanımlar ile yazılımlar noktasında farklı bakışı-larının benimsenmesini gerekli kılmaktadır. K işisel bilgisayar donanımı eşya hukuk anlamında bir eşya topluluğu iken, yazılımlar ise fikri mülkiyet hukuku anlamında eser niteliğindedir. Kişisel bilgisayarın sahip olduğu bu özellikler, haciz işlemine konu olduklarında da böyle iki boyutlu bir bakışısının benimsenmesi gerekeceğini ortaya koymaktadır. Buna göre bilgisayar donanımı haczedilirken bunun taşınır bir eşya olduğu göz önünde bulundurulacak, buna mukabil yazılımlar açısından haczin konusunu, aslında yazılımın kendisi değil, borçlunun bu yazılımı kullanmak için sahip olduğu lisans oluşturacaktır. Bu nedenle yazılım kullanım lisansları, taşınırların hac-zine dair hükümlere göre değil, intifa hakkının haczine ilişkin hükümler kıyasen uygu-lanmak suretiyle haczedilmelidir. Kişisel bilgisayarlar günümüzde temel ihtiyaç ya da mesleki ihtiyaç olması sebepleriyle haczi caiz olmayan mal niteliğine bürünebilirler. Bunun yanı sıra, ihtiva ettikleri kişisel veriler ve diğer önemli bilgilerden dolayı sabit diskler – her ihtimalde – haczi caiz olmayan mal olarak kabul edilmelidir.
