Devlet çeşitli işlevlerini yerine getirebilmek ve özellikle
de kamu hizmetlerini sunabilmek için finansmana ihtiyaç duymaktadır. Devletin
söz konusu finansman ihtiyacının önemli bir kısmı ise vergi gelirlerinden karşılanmaktadır.
Ülkemizdeki 2021 yılı bütçe rakamları incelendiğinde, vergi gelirlerinin toplam
bütçe geliri içindeki payının %58.51 olduğu görülmektedir. Bu gösterge
vergilerin devlet açısından öneminin bir ispatı olarak karşımıza çıkmaktadır.
Vergilerin tahsilinde esas olan mükelleflerin vergi
borçlarını vadesinde kanuna uygun surette ödemeleridir. Ancak mükelleflerin
vergi borçlarını vadesinde ödememeleri durumda vergi idaresi vergileri cebren
tahsil etme yoluna gidecektir. Vergilendirme işlemi vergi doğuran olayla
başlayan ve tarh, tebliğ, tahakkuk ve tahsil aşamalarından oluşan karmaşık bir
süreç olduğundan hem vergilerin rızaen ödenmesi hem de cebren tahsili sırasında
mükellefler ve vergi sorumluları ile vergi idaresi arasında bir takım sorunlar
ve uyuşmazlıklar ortaya çıkmaktadır.
Çalışmamızda
söz konusu bu sorunlar ve uyuşmazlıkların yanı sıra, mevzuatta bulunan
tartışmalı hükümler de tespit edilmeye çalışılmıştır. Neticede, tespit edilen bu tartışmalı hükümler
ile uygulamada karşılaşılan sorunlar ve uyuşmazlıklar, gerek yargı organlarının
kararları ve gerekse vergi idaresinin görüşleri çerçevesinde inceleme konusu
yapılarak, çözüm önerileri sunulmaya çalışılmıştır.
The government needs financing in order to fulfill its
various functions and especially to provide public services. A significant
portion of the said financing need of the government is met from tax revenues.
When the 2021 budget figures of our country examined, it is seen that the share
of tax revenues in the total budget revenue is 58.51%. This indicator appears
as a proof of the importance of taxes for the government.
The key point in the collection of taxes is that the
taxpayers pay their tax debts on time in accordance with the law. However, if
the taxpayers do not pay their tax debts in due time, the tax administration
will collect the taxes by force. Since taxation is a complex process that
starts with the taxable event and consists of the stages of assessment,
notification, accrual and collection, some problems and conflicts arise between
the taxpayers, tax responsibles and the tax administration during both the
voluntary payment of taxes and the forced collection.
In our
study, besides these problems and conflicts, controversial provisions in the
legislation were endeavoured to be determined. As a result, these controversial
provisions and the problems and disputes encountered in practice have been
examined within the framework of both the decisions of the judicial organs and
the opinions of the tax administration, and solution proposals have been tried
to be presented.
