The institution of hotchpot claim in Turkish inheritance law is a supplementary legal mechanism aimed at balancing the effects of gratuitous inter vivos transfers made by the deceased on the shares of heirs during the distribution of the estate. The most distinctive feature of this institution is that its applicability largely depends on the intention of the deceased. Articles 669 et seq. of the Turkish Civil Code prioritize the deceased’s intent, while statutory presumptions apply only where such intent cannot be ascertained. This study examines the institution of hotchpot claim from the perspecti- ve of the deceased’s intent and analyzes its application, scope, and limits with respect to descendants and non-descendant heirs from a doctrinal and norma- tive standpoint. In addition, the relationship between hotchpot claim, rules on the distribution of inheritance, and reduction (abatement) is explored, with particular attention paid to frequent misclassifications in practice. The study concludes that the purpose of hotchpot claim is not to achieve strict mathematical equality among heirs, but rather to establish a balance consistent with the deceased’s intent. Accordingly, priority should be given to identifying the explicit intent of the deceased, and statutory presumptions should be interpreted narrowly.
