Disclaimer of inheritance is a right that grants the heir the opportunity to reject the status of heirship. The exercise of this right extinguishes the status of heirship with retroactive effect. As a rule, heirs have the right to disclaim the inheritance. However, in the presence of one of the grounds specified in Article 610 of the Turkish Civil Code, the heir is deemed to have accepted the inheritance unconditionally and without reservation. The disclaimer of inheritance may result from the will of the heir or from a statutory regulation. For an heir who wishes to disclaim the inheritance by their own free will, possessing full legal capacity to act is a condition or a rule required for validity. Similarly, in order to file a lawsuit for the determination of constructive disclaimer, the heir must possess the capacity to exercise civil rights. The issue of how this right, which is not strictly personal, shall be exercised in respect of minors or restricted persons possessing the power of discernment, namely persons with limited legal capacity to act, is important. If the heir does not possess full legal capacity to act, the disclaimer must be performed by the legal representative, or the legal representative must participate in this transaction. There are certain differences in this regard depending on whether the heir is under guardianship or parental authority. The objective of this study is to examine the exercise of the right to disclaim inheritance by persons with limited legal capacity to act, taking into account whether they are under guardianship or parental authority, and the circumstances that cause the forfeiture of this right with respect to the said persons.
