Personal data, which has become even more important in the digital age, is an essential aspect of the right to privacy. A violation of personal data is nothing less than a violation of privacy. When we speak of the data controller’s liability, we are referring to the liability of an organization that violates the right to privacy.

Ever since the capitalist system realized it could break down the individual’s personhood into its constituent parts and convert them into revenue streams, data controllers have established massive organizations—ranging from employees to algorithms, and from servers to artificial intelligence. All of these organizations have a single goal: to maximize profit. At this point, abandoning the individual—who stands virtually alone against the entire capitalist system—to the grueling and often fruitless path of fault-based liability is incompatible with conscience. As we have observed, the legislature has not permitted this either; it has regulated the data controller’s liability as a specialized and concretized form of organizational liability—a type of strict liability based on the principle of due care.

While this study thoroughly establishes the legal foundation for the aforementioned finding, it also comprehensively addresses the multi-layered liability regime—ranging from contractual liability to the liability of employers, and from unjust enrichment to actions for the protection of personality rights.

As such, this book serves as a guide for those seeking to fully understand the obligations of the data controller.
